These Terms of Service ("Terms") govern your access to and use of the games, bots, servers, websites, and other services (collectively, the "Services") offered by WayLessSad LLC ("WayLessSad," "we," "us," or "our"), a limited liability company organized under the laws of the State of Colorado, United States.

By accessing or using any of our Services — including our Roblox experiences (such as DCS-115), our Discord servers and the Anastasia bot, our website at waylesssad.co, and any related content — you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. ABOUT THESE TERMS AND THIRD-PARTY PLATFORMS
Many of our Services are delivered through third-party platforms that we do not own or control, including but not limited to Roblox Corporation ("Roblox") and Discord Inc. ("Discord") (each a "Platform"). Your use of any Platform is also governed by that Platform's own terms of service, community standards, and privacy policies. Those Platform terms are separate from and in addition to these Terms. Where a Platform's terms conflict with ours, the Platform's terms control with respect to your use of that Platform. We are an independent, unaffiliated creator and operator on these Platforms; we are not endorsed by, sponsored by, or partnered with Roblox or Discord unless expressly stated. We operate in accordance with the terms of service of the Platforms we build on. We are not responsible for the acts, omissions, availability, security, or policies of any Platform.

2. ELIGIBILITY AND CHILDREN
Our Services are offered to a general audience that may include children. Access by minors is controlled in significant part by the third-party Platforms through which our Services are delivered, and such access is subject to those Platforms' age requirements, parental-control tools, and terms of service.

- Where a Platform sets a minimum age or age-gating requirement (for example, Roblox or Discord account-age rules), you must satisfy that Platform's requirements to use our Services on that Platform.

- Children under 13 may access certain Services only to the extent the relevant Platform permits and within the protections that Platform provides. We rely on our Platform partners' age-assurance and parental-consent mechanisms and operate in accordance with them.

- For Services we provide directly (such as our website, newsletters, or direct-payment services), see the age provisions in our Privacy Policy (https://waylesssad.co/privacy). If you are a parent or guardian and believe a child has provided us with information improperly, contact us at privacy@waylesssad.co (see our Privacy Policy for details). If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian.

3. YOUR ACCOUNT AND CONDUCT
You are responsible for your activity on our Services and for any account or identity you use to access them (including your Roblox and Discord accounts). Your use of the Services is subject to our Community Guidelines, available at https://waylesssad.co/community-guidelines, which are incorporated into these Terms by reference. The Community Guidelines describe the behavior expected within our community in greater detail, and you agree to follow them. Without limiting those Guidelines, you agree NOT to:

- Violate any applicable law, these Terms, our Community Guidelines, or any Platform's terms or community standards;
- Harass, threaten, bully, dox, impersonate, or harm other users;
- Post or transmit content that is unlawful, hateful, sexually exploitative, or that sexualizes minors in any way;
- Exploit, cheat, datamine, reverse-engineer, or interfere with our games, bots, or servers, or attempt to gain unauthorized access to any system;
- Use bots, scripts, or automation to disrupt the Services (except our own provided tools);
- Buy, sell, or transfer in-game items, currency, accounts, or roles except as expressly permitted by us and the relevant Platform;
- Circumvent moderation, bans, or safety systems, including those operated by the Anastasia bot.

We may suspend, restrict, or terminate your access to our Services at any time, with or without notice, for any violation of these Terms, our Community Guidelines, or for conduct we reasonably believe is harmful to the community, our Services, or others. Where we reasonably believe your conduct violates a Platform's terms, involves unlawful activity, or poses a risk of harm to any person, we reserve the right - and in some cases are obligated - to report you and the relevant activity to the applicable Platform (such as Roblox or Discord) and/or to law enforcement or other authorities, and to cooperate with them.

4. COMMUNITY MODERATION AND THE ANASTASIA BOT
Our Anastasia bot includes automated moderation and safety/distress-detection features. This means:
- Discord messages within our communities may be automatically flagged, logged, and tracked by the bot for moderation purposes;
- The bot may act automatically and on its own - including issuing punishments such as warnings, mutes, kicks, or bans - and uses third-party artificial-intelligence services to help assess the context of a situation and determine whether intervention is necessary;
- Messages are automatically scanned when sent on our server, for the purpose of moderation or distress, risk, or harm;
- When the system detects such indicators, it may flag, log, or escalate the content to human moderators so they can respond appropriately;
- These automated processes constitute automated processing of content for moderation and safety purposes, and human review may follow.

The bot is primarily a community-moderation tool. When you use tickets, the vent system, or other one-to-one team-to-user services, your activity and communications are logged in our systems. While we work to keep this content confidential and accessible only to authorized team members, we cannot guarantee confidentiality against bad actors, unauthorized access, or other circumstances outside our reasonable control.

Please understand:
- WayLessSad is not a mental-health provider, crisis service, or emergency responder. These features are community-support tools, not professional, clinical, or emergency services.
- We cannot guarantee that detection will be accurate, complete, timely, or that any particular outcome, response, or confidentiality will result. Some situations may not be detected; some flagged content may be a false alarm.
- We do not promise that escalations will or will not involve any particular person or authority. If you or someone else is in immediate danger or crisis, contact local emergency services or a qualified crisis resource right away.

We design these features to prioritize user safety while limiting data collection to what is reasonably necessary for the moderation and safety purposes.

5. VIRTUAL ITEMS, PAYMENTS, AND PURCHASES
Our Services may involve purchases of two general types:
(a) Platform-based purchases. Virtual goods, passes, currency (such as Robux), or other items bought through a Platform are processed by that Platform under its terms. We do not receive or store your payment-card details for these transactions, and refunds for Platform purchases are governed by the Platform's policies, not ours.


(b) Direct purchases. Where we offer goods or services purchased directly from WayLessSad (for example, through a third-party payment processor we designate), those transactions are handled by our payment processor under their terms, and the specific purchase terms, pricing, and refund policy presented at checkout apply.

For all purchases:
- Virtual items have no monetary value, are licensed (not sold) to you for personal, non-transferable use within the applicable Service, and may be modified, suspended, or discontinued at any time.
- Except where required by law or expressly stated at the point of sale, all purchases are final and non-refundable.
- You are responsible for all applicable taxes.


6. INTELLECTUAL PROPERTY AND YOUR CONTENT
Our content. The Services and their content - including game lore, characters, designs, code, art, audio, and the WayLessSad and DCS-115 names and branding - are owned by WayLessSad LLC or its collaborators and licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial enjoyment, subject to these Terms and the relevant Platform's terms. All rights not expressly granted are reserved. Your content. When you submit content through our Services (messages, tickets, journal entries, creations, feedback, etc.), you retain whatever rights you hold in it, but you grant WayLessSad a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, and use that content as necessary to operate, moderate, secure, and improve the Services. You represent that you have the rights to submit such content and that it does not violate these Terms or the law. Feedback you provide may be used by us freely and without obligation to you.

7. THIRD-PARTY SERVICES AND LINKS
Our Services rely on and may link to third-party services (Platforms, payment processors, hosting, analytics). We are not responsible for the content, policies, or practices of any third party. Your dealings with third parties are solely between you and them.

8. DISCLAIMERS
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, accurate, or error-free, that defects will be corrected, or that any safety, moderation, or detection feature will function as intended in any particular case.Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAYLESSSAD LLC AND ITS MEMBERS, OFFICERS, COLLABORATORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID DIRECTLY TO WAYLESSSAD IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.


10. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless WayLessSad LLC and its members, officers, collaborators, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your violation of these Terms, our Community Guidelines, or applicable law; (b) your misuse of the Services; or (c) your content or your infringement of any third party's rights. This obligation applies to the fullest extent you are legally capable of assuming it, and nothing in this section requires indemnification for WayLessSad's own unlawful conduct or gross negligence, or beyond what applicable law permits.

11. TERMINATION
You may stop using the Services at any time. We may suspend or terminate your access at any time as described in these Terms. Provisions that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability, indemnification, and dispute terms -will survive.

12. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. Subject to any applicable mandatory consumer-protection laws, you agree that the state and federal courts located in Colorado will have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to venue there.

13. CHANGES TO THESE TERMS
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
